TERMS AND CONDITIONS

Please read these Terms and Conditions carefully before registering on the Platform. These Terms and Conditions (“Terms”) govern your registration on, participation in, and use of the services (“Services”) provided by Trueage Sports Identity LLP (“Company”) through its website www.sportsid.in and mobile application (collectively, the “Platform” and may also be referred to as “we”/ “us”). The Platform is designed to create a comprehensive sporting passport for young athletes and coaches (“Users”) by collecting and managing personal and sporting data for verification, authentication, and participation in sporting events and programs. The term ‘Users’ shall also include any third-party individual or entity accessing either the Platform or the Services provided by the Company.

These Terms, along with the Privacy Policy, Cookie Policy, KYC Policy, Parent Consent Form, and other relevant policies of the Platform (collectively referred to as “Platform Policies”), form a binding legal agreement between you and the Company, governing your access and use of the Platform and its Services.

By registering on and using the Services of the Platform, you (“User,” “you,” “your”) agree to comply with and be bound by these Terms. If you do not agree with these Terms, you are advised to discontinue using this Platform immediately.

Eligibility

1. By visiting, accessing and using the Platform, you agree and undertake that you:

  • Are a resident of India and above 18 years of age and have the legal capacity to enter into the understanding with the Company in their provision of Services as under these Terms;
  • Have read, understood and agreed to the Terms and agree to be bound by these Terms;
  • If you are under 18, you may use the Platform only with the involvement and consent of a parent or legal guardian.

Modifications to the Terms

2. The Platform reserves the right to amend these Terms at any time and from time to time without prior notice as long as the same does not change the handling of either personal or sensitive information. Any modifications to these Terms will come into effect immediately on their publication on the Platform. However, Users shall be notified of any significant changes to these Terms upon logging in into the Platform. For all other changes, you are requested to peruse these Terms periodically. Your continued use of the Platform signifies your acceptance of any updated Terms.

Registration and maintenance of User Account:

3. Users providing their information must create an account on the Platform in order to create an extensive and comprehensive sporting passport by providing accurate and complete information during the registration process. In case of any change in residence or any other details provided by the User, the User will keep the Platform promptly notified by sending an email to info@sportsid.in for updating their profile (Know Your Customer) details and will also re-upload copies of the Government-issued identification proof, if updated.

4. For all Users, you or your parent/ legal guardian will receive a one-time password (OTP) on the mobile number linked to the verification document provided by You, for the purpose of verification. A User account is successfully created only upon verification of your mobile number via OTP verification process along with any additional verification, if implemented by the Platform.

5. Valid and accurate personal information: You are required to register on the Platform only using your own personal information and your current and valid credentials. You hereby undertake to provide only current and valid credentials and completely accurate information. If there is any inaccuracy in the information furnished by a person or if a person is found using anyone else’s personal information, including any credential, to register and/or use the services of the Platform, action will be taken against such person. If the details provided by you are found to be incorrect and/or inadequate appropriate action may be taken against you for breaching these Terms under applicable laws.

6. You undertake that you will not permit anyone else to access the Services of the Platform through your User account for access the Platform Services through another User’s account. You represent and warrant that you shall not share your credentials/account details with any other person. Sharing or receipt of the Platform login details with any person/User/group or third party is strictly prohibited. In such an event wherein your credentials/ account details have been shared with a third-party you shall keep the Platform, the Company and its affiliates fully indemnified from any damage/injury resulting therefrom.

7. You agree to promptly notify the Platform if you become aware of or suspect that there may have been any unauthorised usage of your username and/or password and/or personal details including mobile number on the Platform. You may contact: contact@sportsid.in to seek any assistance in relation to any security concerns or Platform Policies.

8. Your User account remains subject to your continued compliance of the Platform Policies and of applicable laws. The Platform reserves the right to suspend, terminate or block your access to the Platform at any time for reasons it deems fit, including to protect the safety and integrity of the Platform and of its Users.

9. The Company shall ensure that reasonable security safeguards including but not limited to data encryption, access controls, logging and monitoring, data backups, and contractual provisions with data processors to ensure compliance with security requirements, are being implemented in order to prevent unauthorized access, disclosure, or modification of any User’s information provided to the Company.

Usage of Services of the Platform:

10. The registration on the Platform does not guarantee issue of digital sporting passport.

11. The following persons shall be automatically ineligible to create a digital sporting passport:

  • Minors: Anyone under 18 years of age is not allowed to create a digital sporting passport except with express parental consent taken through our Parental / Legal Guardian Consent Form; or
  • Persons whose User account has been suspended/terminated/blocked for any reason; or
  • Geographical restrictions: Any person who resides in a State or location where access to the Platform is not permitted; or
  • If the Platform detects that any person is found to be impersonating another person or using details of another person to register and/or access the Services of the Platform.

12. You are prohibited from using the Platform:

  • for any unlawful or illegal purpose/object or in any manner that may violate any of the applicable laws;
  • In any manner that may directly or indirectly harm the Government, the Company or its directors, employees, affiliates, distributors, partners, agents, retailers, service providers, the Platform and/or any other User;
  • to infringe the intellectual property rights of the Company in any way, including by removing any copyright and other proprietary notices contained in any content on the Platform or in relation to the Services;
  • to copy, decompile, reverse engineer, or attempt to discover any source code or to sell, assign or transfer any intellectual property embedded in the Platform;
  • Any attempts to gain access to the Platform through unauthorised means will lead to permanent exclusion from the Platform;
  • to send any unsolicited or unauthorized advertisements, promotions, marketing materials or communications;
  • in any manner that is not consistent with these Terms or violates any of the Platform Policies.

13. Geographical restrictions:

  • The Services of the Platform are not intended to be offered in any State or Jurisdiction except the territory of India, any other state or jurisdiction will be considered an “Unauthorized Jurisdiction”. Users present or residing in an Unauthorized Jurisdiction are strictly prohibited from registering on the Platform.
  • In any event, the Platform or the Company shall have no liability whatsoever if you access or attempt to register on the Platform from an Unauthorized Jurisdiction, provide any false information or use any unauthorized measures for purposes of unlawfully accessing, registering and using the Platform.

User Data Collection, Use, and Deletion

14. The Platform collects and processes data in accordance with our Data Protection and Privacy Policy, the Digital Personal Data Protection Act, 2023 (DPDPA), the Digital Personal Data Protection (DPDP) Rules, 2025 and the Information Technology Act, 2000 (IT Act). The types of personal data we collect include, but are not limited to:

  • Personal Data: Names, contact details, gender, date of birth, nationality, photographs of the Users;
  • Sensitive Personal Data: Health information (e.g. injury history, fitness reports), Biometric Data (e.g. fingerprint scans forage verification) of the Users;
  • Sporting Credentials: Records of sporting achievements, certifications, and competition history of the Users; and
  • Educational and Professional Data: Coaching licenses, sports-related training records and academic qualifications of the Users.

15. The Platform collects this data in order to:

  • Create and manage digital sporting passport
  • Provide personalised services and recommendations
  • Improve out Platforms and services
  • Comply with legal obligations.

16. By using the Platform, you consent to the collection and use of your personal data as described above.

17. You may withdraw your consent for data collection and processing at any time by submitting a request to contact@sportsid.in . For details on the withdrawal process and data deletion, please refer to our Privacy Policy at https://sportsid.in/privacy-policy.

Suspension and Termination of User Account

18. The Platform reserves the right to suspend/terminate/block or ban User accounts if the Platform suspects or identifies any violation of any of the Platform Policies and/or any other applicable laws. Upon the occurrence of any such event, the Platform may be required to provide User details, User data and other relevant information to the concerned authority, regulatory body, courts, in compliance with applicable laws or court orders/judgments, notifications, etc.

19. The Platform reserves the right to suspend or terminate your Account immediately in the event of any violation of the Platform Policies, applicable laws or any fraudulent activity having been committed by the User. It also reserves the right to initiate appropriate civil and/or criminal action against the User in case of violation of any of the Platform Policies or of any of the applicable laws.

20. The Platform reserves the right to block your Account in cases where the Platform identifies any cyber fraud or any other fraudulent activity related to a User’s account by a governmental, police or any law enforcement authority or agency or during its own surveillance or investigation.

21. The Platform may deny access to its Platform or any of its portion thereof without notice if the Platform is convinced of the presence of any unauthorised access or use by you, attempt to assign or transfer of any and all rights granted by the Platform to you under this Agreement and violation of any of the provisions of these Terms or any other Platform Policies.

22. Discontinuation/Deactivation: Users are free to discontinue using the services on the Platform at any time by sending us an email indicating such intention at contact@sportsid.in with the subject “Request to Discontinue”.

Representation and Warranties

23. You represent that:

  • You are eligible and competent to provide information to create a digital sporting passport;
  • You are physically present in a jurisdiction in India, and you undertake that you shall always access the Platform and use its Services only from such jurisdiction(s) where usage of the Platform is permitted under applicable laws;
  • You will ensure that the information provided by You to us at the time of registering on this Platform and also during your usage of this Platform, including your password, other personal details, bank details etc, is protected and no such information is disclosed to any third party. The Platform shall not be responsible for any breach of data committed on your behalf. You specifically understand and agree that the Platform will not incur any liability for information provided by You to anyone which may result in Your account being exposed or misused by any other person.
  • You have the requisite knowledge to register on this Platform, and that You are not aware of any physical or mental condition that would impair Your capability and decision to register on this Platform;
  • You understand that the Platform shall not be liable for any loss or consequences that you may sustain as a result of your improper use of the Platform;
  • You agree to indemnify and hold the Platform, the Company, its employees, directors, officers, and agents harmless with respect to any and all claims and costs associated with your misuse of the Platform.
  • You agree and acknowledge that Your account will be used exclusively for the purpose of obtaining a digital sporting passport and for no other purpose.

Limitation of Liability and Indemnity

24. You agree that your use of the Platform and its Services is entirely at your own discretion. The Platform is not liable for any and all consequences resulting from your lawful or unlawful access, use of the Platform and the Services offered by it.

25. You agree that the Platform is not responsible for any issues faced by you, including on account of slow internet connections, faulty hardware, internet connection failure, low computer configuration or for any other reason not attributable to the Platform which may hinder, stop or affect your participation in any features offered on this Platform. The Platform is also not responsible for any third-party products or services that may be advertised on or received through any links or other sources provided on the Platform or any information, content or advice received through the Platform or links provided on the Platform.

26. You agree to defend, pay, indemnify, and hold harmless the Platform and the Company, along with its licensees, subsidiaries, affiliates, associates, partners and agents from any and all losses, costs, expenses, damages, or other liabilities resulting from any claim, lawsuit, demand, or action brought by any third party or any Government claims. This includes any and all liabilities or costs incurred by the Platform or the Company arising from (a) your access and/or use of the Platform, (b) accessing, attempting to register from an Unauthorized Jurisdiction, providing any false information or using any unauthorized measures for unlawfully accessing, registering and using the Platform; (c) your breach of any of the Platform Policies or applicable laws; (d) any fraud, negligence, wilful misconduct, misrepresentation, forgery, cheating, defamation or intentional wrongdoing on your part; or (e) any action or inaction on your part which may prejudicially impact the business, operations, goodwill and reputation of the Platform/Company and its Services.

27. The Company will not be held responsible for any direct, indirect, remote, punitive, special, incidental, consequential or exemplary damages (such as, but not limited to, loss of business, revenue, profits, or goodwill) resulting from or related to the Platform or the Services. This includes, but is not limited to, any loss arising from: (a) the use or inability to use the Platform, (b) the actions and conduct of any User on the Platform, (c) unauthorized access to or modification of data or transmissions, (d) malicious or criminal activities, or fraudulent transactions by the User, and (e) technical or operational hindrances/errors on the Platform.

Governing Law & Dispute Resolution

28. The Platform Policies, along with your use of the Platform, are governed by and interpreted in accordance with the laws of India, notwithstanding any conflict of law provisions. Either Party has the right to seek interim relief at the appropriate forums or courts with proper jurisdiction. In the event of any dispute arising from the Platform Policies or your use of the Platform, you may file a claim against the Company. The courts in Mumbai, India will have exclusive jurisdiction over all matters related to the Platform Policies and your use of the Platform.

General Provisions

29. Entire Agreement: The Platform Policies constitute an entire, valid and binding agreement between you and the Company and governs your access and use of the Platform at all times.

30. Advertisement: the Company shall have the right to place advertisements and publicity materials of its choice, including that pertaining to parties other than itself for commercial use through electronic means on the Platform.

31. Waiver: The failure of the Platform to exercise any right provided for herein shall not be deemed a waiver of its any further right hereunder and under any of the Platform Policies and applicable laws.

32. Assignment: You may not assign or sub-license, without the prior written consent of the Company, the rights, duties or obligations under the Platform Policies, in whole or in part, to any person or entity. The Company may assign or sub-license in whole or in part any of its rights, duties or obligations under the Platform Policies to any of its affiliates.
